HM King Hamad Ratifies New Law on Private Educational Institutions

Manama: His Majesty King Hamad bin Isa Al Khalifa has ratified and promulgated Law (4) of 2026, a significant legislative step concerning the regulation of private educational institutions. This development follows the approval of the law by both the Shura Council and the Council of Representatives, marking a new chapter in the governance of private education within the nation.

According to Bahrain News Agency, the newly ratified law outlines several key articles designed to ensure the smooth integration and operation of private educational institutions under this updated legal framework. Article I of the law states that its provisions are to be immediately enforced, setting the stage for a comprehensive regulatory environment.

Article II clarifies that the provisions of the existing Law (27) of 2005 regarding education will continue to apply in areas not specifically addressed in the new law, provided there is no conflict between the two. This ensures continuity while aligning with the new directives.

The law further empowers the Minister of Education, as per Article III, to issue the necessary executive regulations and decisions to implement the law. Until these new regulations are formulated, current decisions will remain effective as long as they do not contradict the provisions of the new law.

Article IV mandates that all private educational institutions in operation at the time of the law's enactment must align with its provisions within a year. This requirement underscores the government's commitment to a uniform regulatory standard across all private educational entities.

Furthermore, Article V repeals previous provisions related to private educational institutions as stipulated in Decree-Law (25) of 1998. It also annuls any regulations that conflict with the newly attached law, ensuring a streamlined legal framework.

Finally, Article VI stipulates that the Prime Minister and relevant ministers are responsible for implementing the provisions of the new law, which is set to become effective the day following its publication in the Official Gazette. This prompt implementation reflects a proactive approach to education reform in the country.
